Withdrawal

Withdrawal form

Parents, as consumers, have the right of withdrawal according to §§ 3, 3a KSchG and the Distance and Off-Premises Contracts Act (FAGG): The parent can withdraw from a mediation contract within 14 days without stating any reasons. The withdrawal period begins on the day of the conclusion of the contract.

The parent does not have the right of withdrawal in the following cases:

  1. Contracts for services, if Mary P. - based on an explicit request from the parent and confirmation from the parent regarding awareness of the loss of the right of withdrawal upon complete fulfillment of the contract - started the execution of the service before the expiration of the fourteen-day withdrawal period and the service was then fully provided.

  2. Contracts for the supply of digital content not stored on a physical medium, if Mary P. - with the explicit consent of the parent, coupled with the parent's acknowledgment of the loss of the right of withdrawal in the event of early commencement of performance, and after providing a copy or confirmation in accordance with § 5 para. 2 or § 7 para. 3 FAGG - started delivery before the expiration of the withdrawal period.

The declaration of withdrawal is not bound to any specific form. The parent can use the sample withdrawal form below or another clear statement for this purpose. The withdrawal period is observed if the withdrawal declaration is sent within the period. If the parent withdraws from the contract, Mary P. promptly refunds all payments made by the parent. If the parent withdraws from the contract after expressly requesting early action and Mary P. has commenced performance, the parent must pay Mary P. an amount that is proportionate to the contractually agreed total price and corresponds to the services provided by Mary P. until the withdrawal.
